Terms and Conditions

In these General Terms and Conditions, the following definitions apply:

• General Terms and Conditions: this document, binding for Users, Suppliers, and Partners.
• User: any natural or legal person who submits a quotation request via the platform or uses the services.
• Supplier or Professional: any natural or legal person who offers services and/or products via the platform.
• Quotation Request or Lead: a request submitted by a User via the website to get in contact with a Supplier.
• Contract: the agreement arising from registration or use of the platform, including these General Terms and Conditions.
• Credit Packs: prepaid credits that grant Suppliers access to Quotation Requests.
• Extranet: the secured part of the website, accessible only to registered Suppliers.
• Services: the matching services offered by Bouwmatcher between Users and Suppliers.
• Partner: companies or organizations that enter into a cooperation with Bouwmatcher outside the supplier agreement.

Review: an evaluation of a Supplier by a User.

Bouwmatcher provides an online platform that acts as an intermediary between Users and Suppliers. Bouwmatcher is not a party to the agreements concluded between Users and Suppliers and bears no responsibility for their execution, compliance, or quality. Bouwmatcher does not guarantee the number of quotations, the quality of Suppliers, or the final execution of works.

• A User registers by submitting a Quotation Request.
• A Supplier registers via an Order Form or through the Extranet.
• Suppliers must provide accurate, up-to-date, and complete information. Bouwmatcher may refuse registrations without stating reasons.

Each user is responsible for keeping their login credentials confidential. Any misuse, loss, or unauthorized use must be reported immediately to Bouwmatcher.

The User guarantees that:

• all provided information is accurate and truthful;
• Quotation Requests are submitted with a genuine intent to purchase;
• requests are not used solely to compare competitors’ offers without purchase intent.

The User is liable for the accuracy of all data provided.

The Supplier commits to:

• following up on Quotation Requests within 48 hours of receipt;
• providing accurate and feasible quotations;
• submitting only offers that can actually be carried out;
• communicating respectfully and professionally with Users;
• ensuring the quality and execution of their services.

Bouwmatcher may impose sanctions or suspend accounts in case of repeated complaints or violations of these terms.

• The services of Bouwmatcher are free of charge for Users.
• Suppliers pay a fee via Credit Packs or invoicing.
• Credit Packs are valid for one year and are non-refundable.
• Invoices are payable via direct debit or automatic collection, unless otherwise agreed in writing.
• In case of non-payment, Bouwmatcher may suspend access to the Extranet.
• Late payments incur a default interest of 1% per month, plus a fixed compensation of 15% of the outstanding amount (minimum €50).

A Supplier may submit a complaint within ten (10) calendar days after receiving a Quotation Request via the Extranet. Complaints are only valid if:

• the User has no genuine purchase intent;
• the User is a student, competitor, or located outside the Supplier’s service area;
• the request falls outside the pre-agreed criteria;
• the request is identical to one received within the previous two weeks.

Bouwmatcher decides autonomously and definitively on the validity of a complaint. Approved compensation is granted exclusively in the form of credits.

• Reviews must be honest, respectful, and based on personal experience.
• Bouwmatcher may remove reviews that are inappropriate, misleading, or offensive.
• Posting false or manipulated reviews is prohibited.
• Suppliers may submit reasoned requests for review removal.

• All intellectual property rights related to the platform, software, logos, texts, images, and designs belong exclusively to Bouwmatcher.
• Use, reproduction, or distribution without prior written consent is prohibited.

Users and Suppliers retain rights to their own content but grant Bouwmatcher a limited, non-exclusive license to use it for promotional and publication purposes.

• Bouwmatcher is not liable for damages arising from agreements or transactions between Users and Suppliers.
• Bouwmatcher does not guarantee continuity, a minimum number of quotations, or service quality.

Internet outages, viruses, technical failures, or data errors are not covered by Bouwmatcher’s liability.

Bouwmatcher cannot be held liable for failures caused by circumstances beyond its reasonable control, including but not limited to network failures, strikes, natural disasters, pandemics, or governmental measures.

• Bouwmatcher may terminate the Contract with immediate effect in cases of non-payment, fraud, abuse, or breach of these terms.
• Paid amounts are non-refundable.
• Suppliers may terminate their contract with a notice period of two (2) weeks.

Bouwmatcher may temporarily or permanently suspend accounts in case of suspected fraud or abuse.

Bouwmatcher processes personal data in accordance with its Privacy Policy and Cookie Policy published on the website. Users and Suppliers have the right to access, correct, and delete their data. Complaints may be filed with the Data Protection Authority.

Bouwmatcher reserves the right to amend these General Terms and Conditions at any time. Updated terms are binding from the date of publication. Continued use of the platform constitutes acceptance of the amended terms.

These General Terms and Conditions are governed exclusively by Belgian law. Any disputes fall under the exclusive jurisdiction of the courts of Leuven. Parties agree to first attempt an amicable settlement.
